Who we are
We’re an independent comparison and education service for Texas electricity plans. We are not an electricity provider, utility, or the Public Utility Commission of Texas, and we are not affiliated with PowerToChoose.org.
What we do (and don’t do)
We help you understand plans and estimate potential costs using plan rules and your usage. We do not sell electricity or process enrollments. When you pick a plan, we link to the provider’s site so you can enroll there. You are responsible for reviewing the provider’s current Electricity Facts Label (EFL) and contract.
Rankings & sponsored placement
- Plans are listed by total estimated cost (lowest to highest).
- We may show one sponsored plan in a clearly labeled top placement only if it already ranks within the top 10 and has a 3.5★+ rating.
- The sponsored card shows its true global rank (for example “#7 overall”). Sponsorship does not change rankings or prices.
Estimates, availability, and accuracy
- Taxes and regulated charges: Unless we explicitly say otherwise, sales taxes and other regulated charges are not included in example totals. Your final bill may include these amounts.
- Billing window: Providers may bill on different cycles (for example mid-month to mid-month). We model usage from the first to the last day of each calendar month. If your provider’s cycle differs, your actual bill may vary.
- Validation tolerance: We reserve a 7% calculation tolerance in monthly estimates to account for rounding, proration, meter reads, and EFL nuances.
- Weekly refresh: We collect and normalize plan data on a weekly cadence. Providers can change rates or remove a plan without notice. Our site may not reflect sudden changes immediately.
- Your responsibility: Always confirm the current EFL, plan availability, and pricing on the provider’s website before enrolling. We’re not responsible for provider rate changes or plan removals.
- New-customer premise: Unless we say otherwise, offers shown assume new-customer eligibility. If you are an existing customer with the same provider, you may not qualify for the same promotional plan or price.
User-Generated Content (UGC) rights
- Ownership: You retain ownership of your UGC.
- License: You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, adapt, translate, create derivative works (formatting/layout), publish, publicly display, publicly perform, and distribute your UGC to operate, promote, and improve the service.
- Your promises: You have the rights needed to grant this license; your UGC is lawful and accurate to the best of your knowledge; and it does not infringe others’ rights.
- Moderation: We may edit, refuse, remove, or disable access to UGC at our reasonable discretion (for example if it violates these Terms or law). We may preserve information where appropriate.
- No compensation: We do not owe compensation for use of UGC under this license.
- Feedback: Ideas or suggestions may be used by us without restriction.
Accounts & eligibility
You must be able to enter into a binding contract and comply with applicable law. Keep your account information accurate and secure; you are responsible for activity under your credentials.
Code of Conduct (user behavior; moderation & bans)
To keep the service useful and safe, you agree to:
- Be truthful and lawful: use accurate info; only upload or connect data you are authorized to use.
- Respect others: no harassment, threats, hate, or doxxing.
- Protect security: do not access others’ data; do not probe, bypass, or interfere with security or rate limits; do not upload malware.
- Use as intended: one person per account; no impersonation; do not scrape, bulk download, reverse engineer, or misuse features; use Smart Meter Texas connections and bill uploads only for lawful purposes tied to your service address(es).
- Intellectual property: do not republish or redistribute site content or data models beyond personal, non-commercial use.
We may monitor, limit, remove content, suspend or ban accounts, block IPs/devices, or preserve information where we reasonably believe these Terms or laws are being violated or risk is present. We may act at our reasonable discretion, with or without notice.
To appeal a moderation action, email support@clearenergyfacts.com with details; we will review and respond as appropriate.
Your uploads and usage data
If you upload bills or connect Smart Meter Texas (SMT), you authorize us to store and process that data to provide features you request (simulations, comparisons, validation). With your consent, we may use de-identified, aggregated usage statistics to compute area averages that help users who do not have their own data. We never share address-specific usage data or identify a specific service address in published stats.
Third-party services
We rely on third-party providers for hosting, analytics, support, document parsing, and SMT connections. Your enrollment with any electricity provider happens on that provider’s website and is governed by their terms and policies.
Intellectual property
The site and its content are owned by us and our licensors. We grant you a limited, revocable, non-exclusive license to use the service for personal, non-commercial purposes.
No warranty
THE SITE, THE SERVICE, AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Estimates are not guarantees; information may be incomplete, out of date, or changed by providers; and third-party content or links are outside our control. Always verify the current EFL and pricing with the provider.
Limitation of liability and release
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or related to your use of (or inability to use) the site or service.
- This includes, without limitation: (a) errors, omissions, or out-of-date information (including provider price/availability changes or plan removals); (b) outages, delays, or failures; (c) security incidents or unauthorized access not caused by our willful misconduct; (d) reliance on estimates, comparisons, or other outputs; (e) third-party sites, services, or APIs you access via links or integrations; and (f) actions or omissions of electricity providers or other third parties.
- Aggregate cap: our total liability for all claims will not exceed the greater of $100 or the amount you paid us in the 12 months before the event giving rise to liability.
- Provider disputes: if you enroll with a provider, that relationship is between you and the provider and is governed by the provider’s terms. To the fullest extent permitted by law, you release us from claims and damages arising from disputes between you and a provider.
Changes to these Terms
We may update these Terms. If changes are material, we will post a notice on the site or email you. Your continued use means you accept the updated Terms.
